1. Acceptance of Terms

By accessing or using any EcoLynk Creations service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Services

EcoLynk Creations provides technology and digital solutions including but not limited to web development, mobile applications, AI solutions, cloud infrastructure, UI/UX design, and digital marketing. The specific scope of each engagement is defined in a signed Service Contract (ECL-4).

3. Payment Terms

All prices are quoted in Kenyan Shillings (KES) unless otherwise stated.
A deposit (as specified in the quote) is required before work commences.
Final payment is due upon project delivery unless agreed otherwise in writing.
Late payments attract a 2% monthly interest charge.
All payments are subject to 16% VAT as required by Kenyan law.

4. Intellectual Property

Upon full payment, the client owns all deliverables created specifically for their project. EcoLynk retains the right to display the work in our portfolio unless otherwise agreed in writing. Third-party components (libraries, fonts, stock assets) remain subject to their respective licences.

5. Client Responsibilities

Provide accurate project briefs and timely feedback.
Supply all required content, assets, and credentials promptly.
Ensure content provided does not infringe third-party rights.

6. Limitation of Liability

EcoLynk's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

7. Termination

Either party may terminate an engagement with 14 days' written notice. Work completed to the termination date is billable. Deposits are non-refundable unless EcoLynk terminates without cause.

8. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved through the courts of Kenya or by mutual arbitration.
